You have a hardware wallet, a multi-sig setup, maybe a split seed phrase stored across three jurisdictions. Your Bitcoin's security is serious.

Can you say the same of your estate plan?

The key operational risk is simple: legally inheriting Bitcoin is not enough if the authorised representative cannot locate it, establish authority or follow a workable recovery procedure. Conversely, knowing a seed phrase does not establish a legal right to take the assets. An effective plan joins those two problems.

Access is only half the issue. Even when heirs can reach the Bitcoin, a poorly structured estate can force taxable liquidations, eroding the wealth the plan was meant to preserve. And if you hold a Bitcoin-backed loan, the risk is higher.

Review Ledn’s beneficiary process with your estate adviser. For pledged BTC, also document loan-management responsibilities.

The Loan Problem Most Bitcoin Borrowers Miss

A loan adds obligations to the estate: outstanding principal, interest, maturity and collateral-management requirements. The agreement determines what death changes; it is not safe to assume every lender immediately liquidates, or that any lender automatically suspends normal LTV monitoring. Obtain written instructions and identify who can act for the estate before a crisis.

If collateral is sold while the estate is being administered, the executor needs the quantity sold, execution price, charges, remaining debt and remaining BTC. The relevant tax basis and holding period must be established separately. A forced sale can reduce the amount of Bitcoin left to distribute even when the resulting tax gain is small or zero.

Illustrative liquidity example: an estate holds 10 BTC securing a $200,000 principal balance, with BTC worth $80,000. Ignoring interest and costs, paying that balance from BTC requires 2.5 BTC, leaving 7.5 BTC. Paying from other estate liquidity could preserve the 10-BTC holding instead. Neither choice establishes the tax outcome: the estate must use the applicable basis and actual disposal proceeds, not automatically the deceased person’s original purchase price.

How Ledn fits into the estate plan

Ledn supports beneficiary designations, but the designation is not a substitute for estate administration. Its beneficiary guidance says Ledn works with the estate’s authorised representative and may request a death certificate, will or other legal documentation. Local law and binding estate procedures still apply.

For an outstanding loan, record the account contact, maturity, repayment options and collateral-management responsibilities. The published beneficiary process does not promise a freeze on liquidation, a specific probate timetable or unrestricted loan continuation after death. Request account-specific guidance from Ledn with your adviser rather than incorporating those assumptions into a will.

Custody is a separate question. Ledn’s Custodied Loan collateral may be posted with an institutional USD funding partner or a Ledn-managed financing vehicle under restricted arrangements. It is not lent out to generate interest. Those controls do not themselves decide who inherits the assets. See the custody-model guide.

Three Inheritance Scenarios

Scenario 1: self-custodied Bitcoin, no usable access plan. A hypothetical holder leaves 15 BTC on a hardware wallet. The executor knows about the device but cannot locate the backup or the required passphrase. Probate authority alone cannot reconstruct a missing private key. A recovery plan prepared during life would address the device, backup, passphrase if any, and an authorised access process. Do not assume a court proceeding or wallet manufacturer can recover inaccessible coins.

Scenario 2: custodial Bitcoin, incomplete estate records. A hypothetical holder leaves Bitcoin on an exchange but no account inventory. The representative must identify the provider, establish authority and satisfy its estate process. During that delay, the market can rise or fall. The planning lesson is to record the account and verified contact route—not to predict a universal processing time or a specific loss of appreciation.

Scenario 3: a documented Ledn account and loan. A hypothetical holder has named beneficiaries, aligned the designation with legal documents and recorded a $300,000 loan. The representative contacts Ledn through a verified channel, establishes legal authority and obtains instructions on managing the account and debt. The estate evaluates repayment using other funds versus an authorised collateral sale. Timing, asset release and tax treatment depend on the agreement, records and law; the beneficiary setting alone does not guarantee them.

How to Build a Bitcoin Estate Plan That Transfers Cleanly

Step 1: Build a Complete Bitcoin Inventory

Before any legal structure or tax strategy is useful, your estate needs to know what exists. This step is easy to miss when holdings are scattered across years of accumulation across wallets, exchanges, and platforms.

For each holding, document the custodian or wallet type, whether that is a hardware wallet, a Ledn account, an exchange, cold storage, or a multi-sig setup. Record the wallet address or account identifier. Note how access is granted, whether by seed phrase, private key, platform login, or a set of multi-sig key holders. Capture the approximate balance as of the document date. Document where the access information is stored and how it can be retrieved.

Keep the inventory and the access information in different locations. Your executor finds the inventory first, then follows it to the access information. That chain needs to be explicit.

Review the inventory after every meaningful change in your holdings: a new loan, a platform migration, a large purchase or sale. An out-of-date inventory sends executors looking in the wrong places.

Step 2: Align Custody With Your Estate Plan

An accurate inventory tells your estate where the Bitcoin lives. The next question is whether the custody structure itself can actually transfer it.

Bitcoin's security model and estate planning are in tension. The features that protect Bitcoin from theft, including air-gapped hardware, split seed phrases, and multi-sig requiring multiple keyholders, are the features that can make inheritance difficult or impossible if the estate plan does not account for them. A secure Bitcoin holding that no one can inherit is, from the estate's perspective, indistinguishable from a holding that was lost.

Multisignature can distribute signing power, but the threshold needs deliberate design. In a 2-of-3 arrangement with one key each held by the owner, a family member and an adviser, the family member and adviser can act together even during the owner’s lifetime; the owner cannot sign alone. Test both the intended inheritance path and the risk of premature collaboration. Document replacement when a keyholder dies, becomes unavailable or changes role. More keys do not automatically mean a safer or more workable plan.

Beneficiary designation on a custodial platform records intended recipients within that provider’s process. Ledn supports one or more beneficiaries. Have counsel resolve any inconsistency between account ownership, the designation, a will and a trust. For substantial self-custody holdings, assess whether specialist recovery support is appropriate, including its powers, fees, continuity and liability. Walk through the plan with the executor without disclosing live secrets unnecessarily.

For holders with significant self-custody positions, purpose-built Bitcoin inheritance services have structured protocols worth evaluating as an additional layer.

Whatever structure you choose, the most important step is to walk through it with your executor before it matters.

Step 3: Write a Will That Addresses Bitcoin Specifically

Custody structure handles the mechanics of access. The will is what gives that access legal force.

A will that says "my digital assets pass to my spouse" tells no one where those assets are, how to access them, what loans exist against them, or who to contact at which platform. It is a sentence that satisfies the form of estate planning without doing any of the work.

Your will, or a legally valid supplementary document referenced by the will, should specify every Bitcoin-denominated holding and its custodian. It should describe the process for accessing each holding, or reference where those instructions are stored. It should address any outstanding Bitcoin-backed loans by lender, balance, and contact information. It should name the relevant platform custodians or key holders. It should indicate whether a specialist digital asset executor or advisor is designated. And it should clarify how beneficiary designations on custodial accounts relate to the will's provisions, because conflict between the two is one of the more common ways estates get tangled in court.

Many estate attorneys remain unfamiliar with Bitcoin custody mechanics. If yours has not asked where your seed phrases are stored, or what happens to your Ledn loan at death, that conversation needs to happen before the documents are finalized. The right attorney will ask.

Step 4: Understand the Tax Mechanics

A well-structured will moves Bitcoin to heirs. The tax code determines how much of it actually arrives.

Note: Tax treatment varies by jurisdiction and is still evolving. The points below apply primarily to US-based holders, and any application to your specific situation should be confirmed with a qualified tax professional.

In the United States, inherited property generally receives a basis tied to date-of-death fair market value, subject to exceptions. For an illustrative holding bought at $5,000 and worth $80,000 at death, an eligible fair-market-value basis adjustment would establish an $80,000 basis. A sale at $80,000 would then have no gain before costs and other adjustments. This is a conditional example, not a promise about every estate, trust or collateral structure.

Do not assume a post-death sale by a lender automatically uses the decedent’s lifetime basis. IRS Publication 559 generally describes date-of-death fair market value as the basis of property received from a decedent, including property sold by an estate, subject to exceptions and valuation rules. Whether collateral qualifies and which basis applies depends on the facts. Forced sale and loss of a basis adjustment are not synonymous.

A trust can provide a legal ownership and administration framework, but its label does not determine all tax results. Counsel should establish how the trust acquires Bitcoin, who can transact, how keys or provider accounts are held and what happens at incapacity or death. Revocable and irrevocable structures have different control and tax consequences. Gifting may also transfer basis and create reporting obligations. None should be adopted solely because an online example promises tax savings.

Step 5: Ask Your Lender These Four Questions

If you carry a Bitcoin-backed loan, or are evaluating one, the lender's policy at death deserves direct questions before you sign. These are:

  1. What happens to an active loan upon the borrower's death? Is it immediate default, or is there a cure period during which the estate can intervene?
  2. Can a designated beneficiary or estate executor continue servicing the loan during estate administration, or does the platform require immediate resolution?
  3. Does the platform support beneficiary designation directly on accounts?
  4. Where is the collateral held, and how is it identified and ring-fenced from lender assets in the event of insolvency or operational disruption?

Ledn’s public beneficiary guidance answers the designation question. The remaining loan questions require the applicable agreement and written account-specific instructions. Record the answers in the estate file, including who may request statements and collateral transactions. This makes the comparison actionable without assuming that a custody policy creates an inheritance guarantee.

If a lender cannot answer these four questions clearly, that is an answer.

Step 6: Keep the Plan Current

A Bitcoin estate plan is not a document you sign once and file.

Review it annually, and after any meaningful change: a new loan, a significant purchase, a platform migration, a price movement that materially alters the composition of your estate. Confirm every keyholder still has their key and is still reachable. Confirm every access instruction still works. Confirm your executor still knows where to start.

The plan that protects your heirs is the plan that reflects your holdings as they are today, not as they were three years ago when you last thought about it.

Make the plan executable, not just legally complete

An inventory, a Bitcoin-aware adviser, aligned beneficiary records and a secure access process give the estate a practical starting point. Add a loan file if any BTC is pledged: agreement, balance, maturity, lender contact and possible repayment resources. Revisit it when account ownership, family circumstances or the borrowing position changes.

For Ledn account holders, begin with the beneficiary settings and confirm outstanding-loan instructions directly. If considering a new loan, review Bitcoin-backed loan terms with the person advising on your estate. A good funding decision should remain workable if someone else has to administer it.

Frequently Asked Questions

Does Bitcoin go through probate?

Probate treatment depends on ownership, valid trust arrangements, local law and the provider’s procedures. A beneficiary designation alone should not be described as universally avoiding probate. Ask counsel to explain the route for each holding and the documents an authorised representative will need.

Can a trust hold Bitcoin?

A properly established trust may own Bitcoin, but its documents, trustee powers and custody arrangement must support that ownership. For a custodial account, verify that the provider accepts the particular trust and what onboarding evidence is needed. For self-custody, document authorised signers and succession. Work with an attorney familiar with both the legal structure and Bitcoin access mechanics.

What is the capital gains tax on inherited Bitcoin?

For US federal purposes, inherited property generally receives a basis tied to date-of-death fair market value, with exceptions. A subsequent sale can produce a gain or loss measured from the applicable basis. Liquidation by a lender does not automatically remove the adjustment. Consult IRS inheritance guidance and a qualified adviser about the actual estate.

What happens to a Bitcoin-backed loan when the borrower dies?

The agreement and estate process govern. Death does not by itself establish that debt is cancelled, monitoring pauses or collateral will immediately be sold. The representative should contact the lender promptly, provide required authority and arrange how repayment, maturity and collateral management will be handled.

Does Ledn support beneficiary designation?

Yes. Account holders can designate a beneficiary directly on the platform. This does not replace a will and should be reviewed with your estate attorney for alignment with your broader plan and jurisdiction.

How do I include Bitcoin in my will?

A general reference to "digital assets" is not enough. Your will should specify each holding by custodian or wallet type, reference where access instructions are stored, address any outstanding loan positions, and name the relevant platforms and contact information. Verify your attorney has Bitcoin-specific experience before finalizing.
